村级治理中的村民代表 -关于村民代表会议制度效能的讨论

内容提要：村民代表会议制度是村级治理中民主决策、民主监督和民主管理的核心。本文通过对村民代表与村民和村干部关系一般图景及例外情况的考察，认为村民代表会议制度能否发挥效能，不仅与制度建设有关，而且与特定的村庄基础有关。正是村民代表的代表能力构成了特定的村庄基础。只有通过制度建设而使村民代表会议制度提供给村民和村干部的收益，大于建设所需要的成本，村民代表会议制度才有良性发展的希望，其效能也才会因此增强。

Abstract: The system of villager’s representative meeting is the core of the democratic decision-making、supervision and management in village’s governance. By the study of the general and exceptional relationships between the villager’s representative and the villager and the village cadre, this paper argues that, the efficiency of the system of villager’s representative meeting bears not only on the institution of system, but also on the particular elements of village, which are just formed by the ability of the representative; Only by the institution of system, which provides with a higher profit than the cost for the villager and the village cadre, can the system of villager’s representative meeting gain a healthful development and a high efficiency.
