On behalf of The Active Network, I am pleased to offer you a position with the Company.
This offer is contingent upon your returning a signed copy of this letter indicating your acceptance, as well as our Employment Agreement.
The terms of your employment relationship with the Company will be as set forth below:
1. Position. You will become a Developer, within Active’s Product Development Department. As such, you will have such responsibilities as determined by the Manager of Xian Office.
2. Base Salary. You will receive a base salary of ￥48,000 per year. Your salary will be payable in accordance with the Company’s standard payroll policies (subject to normal required withholding). Your benefits include social insurance benefits (pension, unemployment, medical and work accident) will accrue upon your start date. There will be the standard three (3) month probation period. An acceptable review of your progress at that time will result in full employee status. The addition of full benefits including additional 10% of your salary for public accumulation fund for housing to your remuneration will occur at the three (3) month mark of employment. Moreover, you will be provided with free lunch service during each working day since your start date.
Performance reviews will be held at the end of each financial quarter. Our view is that results count – this is what we base most of our assessments on – and you therefore have the opportunity to show us your capabilities quickly and be recognized for them.
3. Standard Employee Agreements. You will be required to sign the Company’s standard confidentiality agreement relating to protection of the Company’s proprietary and confidential information and assignment of inventions. In addition, you will abide by the Company’s strict policy that prohibits any new employee from using or bringing with him or her from a previous employer any confidential information, trade secrets, or proprietary materials or processes of such former employer.
4. Start Date. Your employment with the Company will commence May 12th 2008.
5. Entire Agreement. This letter, along with your Employment Agreement, constitutes the entire agreement between the parties and supersedes all other agreements or understandings. By signing this letter you acknowledge that you are not relying on any promises or representations that are not contained in this letter. This letter can only be modified in a written agreement signed by both parties.
We feel that you are very well suited for the job and will be quite successful. We also believe that this is an excellent opportunity for both parties and one at which you can definitely have a lot of fun!
To offer some guidance, performance measurements are generally based on:
1. The volume of results that you produce. This will be directly proportional to the amount of effort that you put in. A lot will be new to you and you will be expected to learn quickly and then start delivering.
2. The quality of results that you produce. The three important factors are (1) the ability to answer customer (both internal and external) queries accurately and quickly and keep the customer happy (2) the desire and ability to keep current with new technology and use that knowledge to meet customer needs and (3) the ability to operate effectively in the Active environment.
3. Your attitude. Do you have a positive attitude and care about what you are doing?

Do you truly care about the customer and doing a great job for them?
